UNDER NO CIRCUMSTANCES SHALL ISOREGISTER, INC. or ISORESPONDER.COM OR ITS OWNERS, PARTNERS, SITE DEVELOPERS, ETC., BE LIABLE TO ANY MEMBER ON ACCOUNT OF THAT MEMBER'S USE OR MISUSE OF OR RELIANCE ON THESE SERVICES. ARISING FROM ANY CLAIM RELATING TO THIS AGREEMENT OR THE SUBJECT MATTER HEREOF SUCH LIMITATION OF LIABILITY SHALL APPLY TO PREVENT RECOVERY OF DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, AND PUNITIVE DAMAGES WHETHER SUCH CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, (EVEN IF ISOREGISTER, INC. OR ITS PARTNERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). SUCH LIMITATION OF LIABILITY SHALL APPLY WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF AND RELIANCE ON THE ISORESPONDER.COM. SERVICES, FROM INABILITY TO USE THE ISORESPONDER.COM SERVICES, OR FROM THE INTERRUPTION, SUSPENSION, OR TERMINATION OF THE ISORESPONDER.COM SERVICES (INCLUDING SUCH DAMAGES INCURRED BY THIRD PARTIES). THIS LIMITATION SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF OTHER SERVICES OR GOODS RECEIVED THROUGH OR ADVERTISED ON THE ISORESPONDER.COM SERVICES OR RECEIVED THROUGH ANY LINKS PROVIDED IN THE ISORESPONDER.COM SERVICES, AS WELL AS BY REASON OF ANY INFORMATION OR ADVICE RECEIVED THROUGH OR ADVERTISED ON THE ISORESPONDER.COM SERVICES OR RECEIVED THROUGH ANY LINKS PROVIDED IN THE ISORESPONDER.COM SERVICES. THIS LIMITATION SHALL ALSO APPLY, WITHOUT LIMITATION, TO THE COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, LOST PROFITS, OR LOST DATA.

ISORegister, Inc. agrees to full privacy of your database and its contacts. Under no circumstances will your contacts be used, mailed to by ISORegister, Inc. or provided to a third party for any reason ever.

Without limiting the foregoing, under no circumstances shall ISORegister, Inc., ISOResponder.com, or its licensors be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning.

You may cancel your ISOResponder.com account at anytime you desire, however there will be no refunds for any charges processed within 72 hours of your cancellation notice. The act of canceling must be made via the online form in the members area or by telephone. If you cancel after a payment has been processed, there will be no refunds for that payment. CANCELLATIONS CANNOT BE MADE VIA EMAIL.

As you get immediate access to the Autoresponder and List Manager, under no circumstances will ISORegister, Inc. refund any money for any reason. You are agreeing to these terms by your own accord without any coercion or intimidation by anyone associated with or not with ISORegister, Inc.,. In addition, you agree not to attempt to charge back or dispute any charges made by ISORegister, Inc. to your credit card, PayPal account, or any other payment processing listed at ISOResponder.com, or any site that gave you access to this Autoresponder, today or in the future. You agree that if you pay monthly, your payment will be paid to ISORegister, Inc. every 30 days from your initial account start date and that you will faithfully pay each payment. THERE ARE NO REFUNDS.

You understand, accept and agree that your ISOResponder.com cannot be transferred or used by anyone other than yourself. You understand that anyone found in violation shall be subject to immediate termination as well as a $50 non-registered user fee. We will track all ip addresses and login details and this information will be periodically checked and if you are found in violation, immediate and severe action shall be taken.

You understand that you cannot use 3rd party mailing services that include ISOResponder.com Autoresponder subscription links or that include links to web pages where your web subscription form is located.

You understand, agree and accept that ISORegister, Inc. accepts no responsibility for the sending of email.

You agree that ISORegister, Inc. shall have the right to suspend your service at any time for any reason without any prior notice. If service is to be suspended for more than 5 days, you will be notified in advance as to the reason.

You understand that ISORegister, Inc. reserves the right to change or modify the terms of this agreement and can deny service to anyone, for any reason, without notice including any unusual use of bandwidth and/or spamming.

You understand that if you are dissatisfied with the Service or with any terms, conditions, rules, policies, practices or guidelines of ISOResponder.com in providing the Service, your sole and exclusive remedy is to discontinue using the Service. And, you further agree that there will be no refund.

You agree to indemnify and hold ISORegister, Inc. all owners, partners, and site developers harmless from any claim resulting from your use of this service that damages any person. Any claims filed against ISORegister, Inc. must be filed in the city of Fairfax and the county of Fairfax in the commonwealth of Virginia, USA and all expenses for such filing shall be the sole responsibility of the person or persons filing such claims.

YOU UNDERSTAND THAT YOU CANNOT UNDER ANY CIRCUMSTANCE IMPORT ANY PURCHASED OR SELF GENERATED LEAD OR EMAIL ADDRESS FROM ANY THIRD PARTY RESOURCE.

YOU HEREBY ACKNOWLEDGE THAT YOU HAVE READ AND FULLY UNDERSTAND THIS USAGE AGREEMENT AND AGREE AND ACCEPT ALL OF T TERMS AND CONDITIONS.
